1. Introduction

These terms of use ("Terms") govern your access to and use of the CompareEngineering.com platform ("the Platform"), operated by CompareEngineering.com Ltd, a company registered in England and Wales (Company No. 17117072), whose registered address is 66 Paul St, London, EC2A 4NA ("we", "us", "our").

By creating an account or using the Platform, you agree to be bound by these Terms. If you do not agree, you must not use the Platform.

2. Service Description

CompareEngineering.com operates a request-for-quotation (RFQ) marketplace for statutory engineering inspection services in the United Kingdom. The Platform enables:

• Customers to submit structured requests for quotation describing their assets and inspection requirements, which are routed to matched inspection providers who submit quotes for side-by-side comparison.
• Brokers to submit RFQs on behalf of their clients, with automatic commission overlay applied to provider quotes.
• Providers to receive, review and respond to RFQs with structured quotes through the Platform.

CompareEngineering.com is an introducer platform. We facilitate introductions between customers and inspection providers. We do not carry out inspections, do not employ inspectors, and are not a party to any inspection contract between a customer and a provider.

3. User Accounts

You must register for an account to use the Platform. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must provide accurate and complete information during registration and keep it up to date.

We reserve the right to refuse registration or to suspend or terminate any account at our discretion, including where we reasonably believe that information provided is inaccurate or that these Terms have been breached.

4. RFQ Process and Indicative Pricing

When a customer submits an RFQ through the Platform, we match the request to relevant inspection providers based on discipline, geography and coverage. Matched providers are invited to review the RFQ and submit a structured quote.

All prices displayed on the Platform are indicative only. They do not constitute a binding quotation, offer or contract. Final pricing is subject to survey, confirmation and agreement with the selected inspection provider. Prices may vary based on actual site conditions, asset configurations, access requirements and other factors.

Where the Platform displays estimated or indicative pricing prior to provider quotes being received, these are automated estimates for guidance only and should not be relied upon.

5. Contract Awards

When a customer selects a preferred provider through the Platform, this constitutes a "contract award". The contract award records the customer's selection and triggers onboarding between the customer and the provider. The inspection contract itself is formed directly between the customer and the provider, subject to the provider's own terms.

6. Broker Accounts

Broker accounts are subject to approval by CompareEngineering.com. Commission rates are set by agreement between CompareEngineering.com and the broker and cannot be altered by broker users within the Platform. Broker users must not misrepresent the nature of the indicative pricing or RFQ process to their clients.

Brokers are responsible for their own regulatory obligations, including any requirements arising from insurance intermediary regulations, and for ensuring that their use of the Platform complies with their obligations to their clients.

7. Fees and Charges

The Platform is free to use for customers. Providers and brokers may be subject to fees as follows:

• Lead fees: Providers may be charged a lead fee when submitting a quote in response to an RFQ. Lead fees are charged on submission regardless of whether the contract is awarded to that provider. Current fee tiers are displayed at the point of quote submission.
• Success commission: A success commission may be charged to the provider when a contract is awarded through the Platform. The applicable rate is set out in the provider's agreement with CompareEngineering.com.
• Broker commission: Broker commission is added on top of the provider net price and is set by CompareEngineering.com. Commission rates are not editable by broker users.

We reserve the right to change our fee structures with reasonable notice. Current fees are always displayed within the Platform before any chargeable action is taken.

8. Acceptable Use

You agree not to:

• Use the Platform for any unlawful purpose
• Attempt to gain unauthorised access to any part of the Platform
• Interfere with the operation of the Platform
• Scrape, copy or reproduce pricing data or provider information for commercial purposes outside the Platform
• Submit false, misleading or incomplete information in any RFQ or quote
• Use the Platform to spam, harass or send unsolicited communications to other users

9. Limitation of Liability

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited under applicable law.

Subject to the above, to the fullest extent permitted by law:

• We shall not be liable for any indirect, incidental, special, consequential or punitive damages arising from your use of the Platform, including but not limited to loss of profits, data, business opportunity or goodwill.
• Our total aggregate liability to you in respect of all claims arising out of or in connection with these Terms shall not exceed the greater of (a) the fees paid by you to us in the 12 months preceding the claim, or (b) £500.
• We are not liable for the acts, omissions, quality of work, pricing accuracy or contractual performance of any inspection provider listed on the Platform. All inspection work is the sole responsibility of the provider engaged.
• We do not guarantee the availability, accuracy or completeness of any information, pricing or content on the Platform.

10. Force Majeure

We shall not be liable for any failure or delay in performing our obligations under these Terms where such failure or delay results from circumstances beyond our reasonable control, including but not limited to acts of God, fire, flood, pandemic, governmental action, failure of third-party services, telecommunications failure, power outage or cyber attack.

11. Service Availability

We aim to keep the Platform available at all times but do not guarantee uninterrupted access. We may suspend or restrict access to the Platform for maintenance, updates or other operational reasons without liability.

12. Intellectual Property

All content, trademarks and data on the Platform are the property of CompareEngineering.com Ltd or its licensors. You may not reproduce, distribute or create derivative works without prior written consent.

13. Termination and Suspension

We may suspend or terminate your account at any time if we reasonably believe you have breached these Terms, provided false information, or if required to do so by law. We will provide notice where reasonably practicable.

You may close your account at any time by contacting us at hello@compareengineering.com. Upon closure, we will retain your data in accordance with our Privacy Policy and any applicable legal retention requirements.

The following clauses survive termination: sections 9 (Limitation of Liability), 12 (Intellectual Property), 15 (Governing Law), and any accrued rights or obligations including outstanding fees.

14. Dispute Resolution

If a dispute arises in connection with these Terms, we encourage you to contact us first at hello@compareengineering.com so that we can attempt to resolve the matter informally. If the dispute cannot be resolved within 30 days, either party may refer the matter to mediation administered by the Centre for Effective Dispute Resolution (CEDR) before commencing court proceedings.

15. Governing Law

These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.

16. Changes to Terms

We may update these Terms from time to time. Where changes are material, we will notify you by email or through the Platform. Continued use of the Platform after changes constitutes acceptance of the updated Terms. Previous versions are available on request.
